The U.S. The Supreme Court ordered the Trump administration to bring back Kilmer Abrego Garcia who was wrongfully deported from the U.S. and sent to a Mega Prison in El Salvador.
What exactly happened?
On March 12th, 2025, Garcia was arrested by Immigration and Customs Enforcement (ICE). Later, the Trump Administration accused him of having some sort of ties to the MS-13 gang in El Salvador and he was deported and sent to the Mega El Salvador prison, without giving him a day in court.
To clarify, Garcia had legal status in the United States, and his wife and 5 year old child are both U.S. citizens. Garcia’s wife sued the United States with her and her son as plaintiffs against this incident.
The Trump Administration classified this incident as an administrative error, but that still didn’t stop them from arguing in court that the courts cannot order them to bring Garcia back from El Salvador because the court lacks “personal jurisdiction”.
On April 4th, Judge Paula Xinis ruled in favor of Garcia and ordered the Trump Administration to bring back Garcia no later than April 7th. However, the Trump Administration appealed this decision to the United States supreme court.
After a temporary hold was put on the deadline for Garcia to be returned to the United States, the supreme court voted unanimously (9-0) to “facilitate” Garcia’s return to the United States.
