The Trump Administration is planning on suspending Habeas Corpus.
What is Habeas Corpus?
Habeas (hay-bee-uhs) Corpus is latin for “you have the body” and it’s embedded in the United States Constitution. It prevents the government from arresting anyone for unlawful reasons and ensures legal representation by a lawyer and for a judge to determine the legality of them being arrested.
Why is Trump suspending it?
The Trump Admin. is planning to suspend Habeas Corpus in his battle against immigrants.
“The Constitution is clear, and that, of course, is the supreme law of the land, that the privilege of the writ of habeas corpus can be suspended at a time of invasion. So I would say that’s an action we’re actively looking at,” stated Miller at the White House Driveway.
It is also noted that Habeas Corpus has only been suspended 4 times in U.S. history, but they were suspended during a time of war. The most recent suspension was in 1941 during World War 2 after the Japanese attack on Pearl Harbor.
In the end, Habeas Corpus is a constitutional right and should not be suspended because it guarantees everyone the right to not be arrested for whatever reason the government might come up with and immigration is not a war, it’s more of a civil and political issue since no fighting.
